			<content:encoded><![CDATA[<p>Can you believe that we are already almost one month through 2012?  This past Saturday, I started up a brand new website strictly dedicated to covering the world of Sports Law.  It is called <a title="Sport in Law" href="http://www.sportinlaw.com" target="_blank">Sport-In-Law</a>.  Check it out and let me know what you think.  I am looking forward to serving as an arbitrator again at Tulane&#8217;s National Baseball Arbitration Competition.  Unfortunately, I have to leave early that Friday, so I will not be able to moderate one of their fantastic panels.  I am also excited to be speaking at the Sports Lawyers Association Annual Conference in May.  It will be held in San Diego, California.  I will be speaking alongside Donald Remy, new NCAA general counsel, on a panel titled, &#8220;Hot Topics in NCAA Legal Issues: Agents and Amateurism.&#8221;  Here are some stories I missed over the past week:</p>

<p><strong>Wasserman Media Group&#8217;s</strong> Athlete Management division has been best known for the leadership of <strong>Arn Tellem</strong>, who represents some of the highest profile athletes in professional basketball and baseball.  Tellem&#8217;s name has recently been in the news regarding whether or not the Texas Rangers will sign his Japanese starting pitcher client <strong>Yu Darvish</strong> by this afternoon&#8217;s deadline, but recently, someone else has stolen the show at Wasserman.  That person is a brand new part of the Athlete Management team and is about to make a huge splash in the sports agent industry.</p>
<p>Wasserman Media Group has long resisted entering the world of representing professional football players.  In order to change course, the company needed a really good incentive.  That incentive just happens to be former Stanford quarterback and likely future #1 overall pick <strong>Andrew Luck</strong>.</p>
<p>Within the past few days, Wasserman Media Group hired Andrew Luck&#8217;s his uncle and NFLPA-certified advisor <strong>Will Wilson</strong>, who will represent Luck leading up to the 2012 NFL Draft.  Wasserman has also named Wilson the company&#8217;s Executive Vice President of Football.  Wilson formerly served as Executive Vice President of International Business &amp; Special Events of Major League Soccer (MLS) and Soccer United Marketing (SUM) for the past four years.</p>
<p>Wasserman Media Group will not only represent Luck with regards to his professional contract with the team that selects him, but the company will also help Luck find opportunities off the field of play, including marketing endorsements, media relations, social media counsel, and charitable and community development.</p>
<p><a title="darren heitner twitter" href="http://www.twitter.com/darrenheitner" target="_blank">On Twitter</a>, I openly wondered whether the signing of Andrew Luck and the establishing of a football division may hamper Casey Wasserman&#8217;s interest in being strongly involved in a future Los Angeles NFL team.  Apparently, Wasserman does not believe that hiring Wilson and representing Luck will conflict with his efforts to bring a team to Los Angeles.</p>

			<content:encoded><![CDATA[<p>This week, the NCAA hosted its annual Scholarly Colloquium on Intercollegiate Athletics.  Jason Belzer and I created a presentation, which took a deep look at the implications of academic reform, as well as the newly instituted standards and other proposed changes.  In analyzing statistical data associated with Academic Progress Rates (APR), we came to a clear determination that if APR standards are raised, there will be a distinguishable disparate impact amongst certain member institutions as compared to the majority of others.  I must thank Jason for presenting for the both of us in Indianapolis.  Jason and I were also covered in the SportsBusiness Journal article, <em><a title="External Link" href="http://www.sportsbusinessdaily.com/Journal/Issues/2012/01/09/Labor-and-Agents/Griffin.aspx" target="_blank">Agent searches increasingly move to campus</a></em>, which talked about our fairly new consulting company, <a title="Collegiate Sports Advisors" href="http://www.collegiatesportsadvisors.com" target="_blank">Collegiate Sports Advisors</a>.  Separately, Kristi Dosh, who covers sports business for ESPN, hosted <a title="External Link" href="http://sportsbizmiss.com/2012/01/10/conference-review-ivy-sports-symposium-and-tulane-national-baseball-arbitration-competition/" target="_blank">an article I wrote about sports business conferences</a> (specifically the arbitration competition at Tulane and the Ivy Sports Symposium).  Here are some stories I failed to cover over the past week:</p>

			<content:encoded><![CDATA[<p>I am back from Barcelona and Israel!  It was a fantastic trip full of sightseeing, eating unbelievable food, and relaxing with my girlfriend and her family overseas.  However, I must admit that it is nice to be back around my friends and family.  You know you are doing what you love when you do not mind getting back to work.  My Miami Heat are off to a great 3-0 start!  I will be attending the home game on Monday against the Atlanta Hawks.  Sports Agent Blog will be turning 6 years old tomorrow.  A site that began on December 31, 2005 as a New Years Resolution to &#8220;force myself&#8221; to stay on top of the happenings in the sports agent industry has become quite the successful venture.  Thanks to each and every one of you reading this post and thousands of other posts that have been written over the many years.  Your continued support will keep a smile on my face.  Here are some stories I missed over the past week:</p>

			<content:encoded><![CDATA[<p>Wow&#8230;what a week.  I officially moved into my new office (send love letters to 175 SW 7th Street, Penthouse Suite 2410, Miami, Florida 33131), and have been busy setting it up while working on behalf of some new, amazing clients.  I have expanded my practice to include quite a few major entertainment figures and was determined not to let my move get in the way of my work.  Anyway, things are finally settling down on that front, but will become hectic again next week as I move my residence from downtown Fort Lauderdale to downtown Miami (specifically, <a title="External Link" href="http://www.tenmuseumpark.com/building.html" target="_blank">Ten Museum Park</a>).  And I also get to look forward to Yom Kippur this weekend.  Sarcasm aside, I am looking forward to representing a new client &#8211; Playboy Playmate Miss October 2011, <a title="External Link" href="http://twitter.com/#!/amandacerny" target="_blank">Amanda Cerny</a>.  Here are some stories I failed to cover over the past week:</p>

<p>Back in April 2011, <a title="External Link" href="http://blogs.hoopshype.com/blogs/sierra/2011/04/25/fernandez-changing-agents/" target="_blank">HoopsHype reported</a> that <strong>Rudy Fernandez</strong> sent a termination letter to <strong>Andy Miller</strong> of <strong>ASM Sports</strong> and Spanish agency <strong>U1st Agency</strong>.  At the time, it was only known that Fernandez was signing with Spanish agent <strong>David Carro</strong> of <strong>Hoops Fair Play</strong>.  Soon thereafter, Fernandez also signed with <strong>Arn Tellem</strong> of <strong>Wasserman Media Group</strong>, which provided him with a strong international agent and a prominent agent within the United States.</p>
<p>Fernandez, a 6&#8217;6 shooting guard/small forward, is currently signed to the Dallas Mavericks, but is playing with Real Madrid while the NBA and NBPA try to come to an agreement on a new collective bargaining agreement.  Raul Barrigon recently got a hold of Fernandez and <a title="External Link" href="http://blogs.hoopshype.com/blogs/barrigon/2011/09/22/rudy-fernandez-ive-proved-i-can-be-a-tough-defender/" target="_blank">asked him quite a few questions</a> about his role with Real Madrid and the Mavericks, but the following Q&amp;A caught my attention:</p>

<p><strong></strong><strong></strong><strong></strong><strong>Rudy Fernandez:</strong> I was not in contact very often with Andy Miller. My agents in Spain handled my day-to-day stuff. I was very happy with Gerard Darnes, Jordi Vila, Nuria Martinez. They were very important for me during my career. But I felt I needed something else… Then <a title="External Link" href="http://www.blazersedge.com/2010/10/11/1745593/nba-fines-blazers-guard-rudy-fernandez-50k-for-comments-made-by" target="_blank">there was the issue with the fines</a>, which I didn’t like… Also some other things happened that I didn’t like. Also in order to change my image I needed this. Now I’m with Arn Tellem, Jose Ortiz and David Carro. Pau [Gasol] and Marc [Gasol] said very good things about Tellem and I’m happy about this change.</p></blockquote>

			<content:encoded><![CDATA[<p>The sports symposiums are starting to sprout up across the country, and I am beginning to formalize my plans regarding which schools I will be attending this Fall.  If you happen to be somewhat near one of the upcoming panels/symposiums, do your best to make it, as they are extremely informative and happen to be great networking events.  I can&#8217;t wait to make my return to Gainesville next weekend to see the Florida Gators take on the Alabama Crimson Tide.  We are almost one-fourth through the semester at Indiana University, and the Sport Agency Management class that I am teaching is going great.  More news on my change of legal work to come next week.  Here are some stories I missed over the past week.</p>

			<content:encoded><![CDATA[<p>With a full slate of NFL and NCAA football, it is easy to forget that any other sports exist.  However, the NBA is coming off of a fantastic season with its highest NBA Finals television ratings since 2004 (and I contend that there were much less competing TV options six years prior).  Yet, as each day passes, the NBA inches closer and closer to forfeiting 2011/12 regular season games.</p>
<p>NBA owners and the National Basketball Players Association (NBPA) are certainly not sitting idle.  However, I still do not feel a strong sense of urgency from either side of the bargaining table.  That could soon change, as many prominent basketball agents are making it known that they wish to decertify the NBPA.</p>
<p>Arn Tellem (Wasserman Media Group), Bill Duffy (BDA Sports), Mark Bartlestein (Priority Sports), Dan Fegan (Lagardère Unlimited) and Jeff Schwartz (Excel Sports) have collectively had their names printed by many media outlets over the past week.  These gentlemen have decided that they are in favor of decertification of the players&#8217; union, which would allow their clients to file antitrust lawsuits against the NBA.  As long as the NBPA exists as a certified union of NBA players, the players forfeit their right to sue for any antitrust claims.</p>
<p>Journalists have been quick to point out that the five aforementioned agents collectively represent roughly thirty percent of the active players who comprise the NBPA, which happens to be the percentage of players needed to sign a petition in favor of decertification prior to all players in the union voting on the matter.  Thereafter, a simple majority would effectively decertify the NBPA.</p>
<p>This discussion reminds me of <a title="External Link" href="http://www.nba.com/2011/news/features/david_aldridge/07/04/morning-tip-labor-update/?ls=iref:nbahpt1">an article written</a> by NBA.com columnist David Aldridge on July 4, 2011, where he said,</p>
<blockquote><p>Players are much more unified this time around than in ’99, in no small part because [Billy] Hunter has <strong>neutered the influence of powerful player agents</strong> like Arn Tellem, Mark Bartlestein and Bill Duffy, with an executive committee comprised mainly of middle-class players like Roger Mason, Jr. and Keyon Dooling.)</p></blockquote>
<p><a title="Billy Hunter decertification" href="http://www.sportsagentblog.com/2011/07/12/has-billy-hunter-neutered-the-influence-of-powerful-player-agents/" target="_blank">I wrote a reply</a>, respectfully disagreeing with Aldridge&#8217;s assessment.</p>
<blockquote><p>It is naive to think that the “middle-class players” will control negotiations on the players end, especially when a big problem with the current system is the large dollars that mid-level players are receiving.  The heavy hitting agents will be involved, whether or not they represent any players on the Executive Committee.</p></blockquote>
<p>At this point in time, it seems as though the major agents are actively involved and will not be ceding control any time soon.  Whether this is a good thing for the NBA, in general, remains to be seen.</p>
