The Western Conference playoffs had such promise when the regular season ended. A young Oklahoma City team got an unlucky draw against the big bad Lakers, a coach Karl-less Nuggets team faced the insignificant Jazz, the ever so delicate Trail Blazers tried to finally make a splash against that old Canadian guy in Phoenix. Oh, and the Mavericks played the Spurs, but other than Texas, who really cared?

Unfortunately the West is where you go to have whatever Cinderella hopes there is in professional sports shattered (See Al Davis’ Raiders 2003-forever).

The Rundown:

LA vs. OKC

A scrawny kid who couldn’t lift 185 pounds in a weight room three years ago all of a sudden carried an entire city and franchise to its first playoff series since Ray Allen wore the green and gold in Seattle. Where did it land him? Face to face with arguably one of the best basketball players of all time; oh dear. However, the Thunder sparked hope in NBA fans, as their team of kids who are barely old enough to drink, took two from the defending champs and tied up the series! Unfortunately all good things must come to an end; it was a shame, though, that it had to be off a Bryant miss and a Gasol last second tip in. (LAL win 4-2)

Denver Nuggets vs. Utah Jazz

The Denver Nuggets have been the team to cheer for since their loveable coach, George Karl, took a leave of absence to fight throat cancer. Unfortunately nobody told his team they were supposed to keep playing! Carlos Boozer and Deron Williams decided to play like the last dynamic duo that laced ’em up for Jerry Sloan and send the Nuggets home. (UTH win 4-2)

PHX vs. POR

Since Brandon Roy became the face of their franchise (better him then Greg Oden and his exploratory photographs), the Portland Trail Blazers have lost their nickname of just ‘Blazers’ and become a fun team to watch over the season. However, they have not been a title contender since Kobe lobbed that ally-oop to Shaq in game 7 of the Western Conference finals in 2000. All they had to do was stop the Benjamin Button of the NBA in Steve Nash and they move on, right? Wrong. Brandon Roy gots hurt, LaMarcus Aldridge still isn’t a star big man, and Jarron Collins wons a playoff series as a starting center. Yeah that’s right, Jarron Collins. (PHX win 4-2)

Dallas Mavericks vs. San Antonio Spurs

A blockbuster trade, rejuvenated roster, and a prehistoric Spurs team should equal an easy opening round series, except that the basketball gods like picking on Mark Cuban because he is like a kid who never learns his lesson. Thanks to Manu Ginosebleed* and the always classy Tim Duncan, the Spurs once again bent those kids from Dallas over their knee and well, the rest is just history. A thought to keep on the back-burner - If the San Antonio Spurs continue this tough play, with a young bench and good shooting, could they upset the Lakers and once again make David Stern cry over horrific NBA finals ratings? You kind of have to hope so. (SAS win 4-2)

So far this year’s playoffs have been a bit of a disappointment, considering there was a whopping zero games that went into overtime in the West, but the 2 seed and 4 seed lost, yet no one called it an upset? When do the playoffs start getting fun again? I kind of miss the intensity, the loud fans, and the hustle the players show for the unnecessarily long playoff runs.

As for how the West was won: The Spurs beat the Suns in 6, the Lakers beat the Jazz for the third consecutive year in 6 because Kobe starts to make that snarling face and Deron Williams gets spooked. Lakers take down the Old fellas from Texas after a long 7 game series. Congrats Kobe, here is your chance to make that Jordan vs. Bryant comparison everyone loves.

No matter how many times I address the issue, I continue to get at least one question a day through email (and sometimes on this site), asking whether law school is necessary or even preferable for someone who is looking to break into the sports agent industry. Another related question is whether an MBA, Masters in Sports Management, or J.D. is the best degree to obtain if one is interested in breaking through the huge barrier of entry. I am reluctant to give an answer to that question, because I can only speak from my own experience. My bias is towards a path of law, where you will have the opportunity to get your first taste of industry-specific knowledge when you take your introductory course in Contracts. Then, in Legal Drafting, you will actually learn how to draw up those contracts. If you take a more specific drafting class, like Analysis and Drafting of Intellectual Property, you will learn specific terms, clauses, and paragraphs that are native to endorsement and marketing deals. If your school offers a class on Negotiation & Mediation, you will learn how to negotiate cooperatively and how to utilize specific claiming and creating strategies, which are invaluable in negotiations (and really the main reason why a client should pay you, in the first place, to negotiate his deals). Additionally, some schools offer very specific industry-related classes like a Sports Law Seminar, which will teach you more of the statutory and precedent based rules guiding our profession.

Wow, that was a long paragraph. But after almost 2 1/2 years of law school, I can now confidently say that I will graduate with a better understanding of the best practices in representing talent, and that I will have an edge over my counterparts who never put in the 3 years to attain a J.D. I did not write that statement with the intention of denigrating anyone’s intellectual capacity, and there are plenty of amazing sports agents who have had tremendous success in scrupulously representing their clients. However, I do believe that there is a lot to gain by going to law school, especially in the realm of learning how to effectively negotiate (which really cannot be learned by just reading a book).

There are a lot more sports agents (A LOT MORE) than there are General Managers in their respective sports. While not every agent has had the proper education necessary to effectively negotiate on behalf of his client, you better believe that every GM knows every trick in the book, whether it be from formal education or years and years of experience. Mark Warkentien, VP of Basketball Operations for the Denver Nuggets, is one of those expert negotiators. During Summer, he spent a week at Harvard Law School in order to enlarge his arsenal of negotiation tools, and shared some of his wisdom with Ian Thomsen of SI. Some important points he talks about are:

The need to know what your counterpart is going to say before you sit down at the negotiating table.

Find points of agreement before starting the negotiation.

Make your counterpart justify his interests and positions.

Face-to-face negotiations beat phone/email/fax conversations.

Showing emotion often does not help you in progressing your position.

Be flexible in negotiations.

Don’t talk down to your counterpart.

Never use the word “but”.

I have learned all of those bullet points, minus the very last one. However, it is definitely an interested point, and one that I may take into consideration when altering my own negotiating style. This is how Warkentien describes Harvard Law School’s justification for scrapping the word “but” from negotiations:

“When you say, ‘I hear what you’re telling me, but …’ what you’re really saying is, ‘Go to hell.’ That word — ‘but’ — comes across as if everything the other guy has just said doesn’t matter.”

As a side note, I will be speaking at Barry University School of Law exactly a week from today. If you are in Orlando, please join the discussion next Monday at 12 p.m. Contact Thomas M.

On Monday, the Denver Nuggets officially announced that All-Star forward Carmelo Anthony will miss the first two games of next year’s season. The suspension stems back to his DUI charge late in the previous season, when Melo was pulled over on I-25. In court, Anthony plead guilty to lesser charges of driving while ability impaired and failure to stay in a single lane. He received 24 hours of community service, one year probation,$1,000 in fines, and court fees by the judge.

Anthony has been in trouble with the law in Denver before. Last year, he was caught and charged with possession of marijuana. This time, the DUI came during a controversial run to gain his Nuggets a spot in the playoffs. It seems that Melo was partying and celebrating for the playoffs a bit too early.

When high priced athletes such as Melo get charged with a DUI it makes us wonder why they don’t just call a taxi or even hire private drivers. Their salaries certainly allow them to do such, but for some reason they still do not. Anthony’s recent outburst and run-ins with the law have caused Denver to shop him around a little this off season. However, it looks as if he will remain a Nugget next year, but will start on the bench for the first two games.

The plea agreement makes the general public question the way athletes are punished by our legal system. This is not Carmelo’s first time in court yet his punishment seemed light to many of us. The truth is first time DUI and drug offenses usually get handled like this. As long as Melo does not mess up again within his probationary period of a year or get a second offense for DUI or marijuana charges, his punishments will remain less serious.

Much like the case of Paris Hilton and her DUI, the celebrity status in this situation only attracts more attention to a first offense that is handled pretty much uniformly throughout the criminal justice system. In Hilton’s case, the Judge issued a more serious punishment because she was so famous. Lucky for Melo, this did not occur.
