<p>Is <strong>Eugene Parker</strong> so busy fielding questions from the media and having discussions with the 49ers front office, that he is not paying enough attention to his veteran clients?  <a title="Internal Link" href="http://www.sportsagentblog.com/2009/08/06/49ers-faithful-are-getting-crabby-with-eugene-parker/" target="_blank">49ers faithful are getting crabby with the agent</a>, and it looks like SportsAgentBlog.com readers are not to thrilled with the Crabtree holdout, either.  Whether or not the Crabtree time commitment has had an effect on Parker&#8217;s representation of his other clients, I would place a bet on the fact that other agents are using it against him.</p>
<p>Yesterday, Liz Mullen of SportsBusiness Journal <a title="External Link" href="http://twitter.com/SBJLizMullen/status/3538645934" target="_blank">reported on Twitter</a> that Atlanta Falcons CB, <span><span><strong>Chris Houston</strong>, dropped Parker for <strong>Todd France </strong>of FAAM.  I also have to think that something about Todd France being around Houston (France is based in Atlanta) had a lot to do with the switch.  Houston probably saw France and his employees around the Flowery Branch, GA facility quite a few times before deciding to change agencies.</span></span></p>
<p><span><span>Drafted in the second round by the Atlanta Falcons in the 2007 NFL Draft, Houston has been a solid contributor, racking up tackles along with his two interceptions last year.  He recently missed some time with a hamstring injury, but as long as he is healthy, I expect a big year out of him.  Todd France is hoping that my expectations are right on.<br />

<p><a href="http://www.sportsagentblog.com/wp-content/uploads/2009/02/caa_logo.gif"><img style="border: 0pt none; margin: 5px 10px;" title="Creative Artists Agency logo" src="http://www.sportsagentblog.com/wp-content/uploads/2009/02/caa_logo.gif" alt="Creative Artists Agency logo" width="226" height="125" align="right" /></a>Creative Artists Agency (CAA), the company with the most amount of first-round selections (9), has all of its clients in camp with Malcolm Jenkins putting pen to paper on a 5-year, $19 million deal.  While the rest of the agencies listed are hoping to get exorbitant contracts for their clients, to use the figures in their recruitment packages for the 2010 class of draft-eligible players, CAA can boast that not only did the company have the highest number of first-round picks, but got them all signed before other big companies like Athletes First and Octagon, small companies with 1 first-round pick like 320 Sports, and signed their boys for good money.  You better believe that Todd France of FAAM will be using the same strategy on the recruitment trail over the next year.</p>
<p>Which method will win out?  The agents who have their clients holdout/threaten to sit out a year well into training camp, or those who get their boys signed for good money and get their boys into camp before the middle of August?</p>

			<content:encoded><![CDATA[<p>Happy July 4th weekend!  Not so happy for Scott Boras <a title="External Link" href="http://coronadelmartoday.wordpress.com/2009/07/01/sports-agents-car-damaged-in-bandera-parking-lot/" target="_blank">and his Range Rover</a>.  I turned in my (roughly) 4,500 word paper on <em>The Duties of Sports Agents to Athletes and Statutory Regulations Thereof</em>.  It&#8217;s nice to have that off of my shoulders.  I will be wrapping up one class next week (Analysis and Drafting of Intellectual Property Law) and my other class the following week (Business Organizations).  I thoroughly enjoyed both classes and learned a lot during this busy summer.  Understanding intellectual property law is very important for any agent who wishes to handle an athlete&#8217;s marketing deals.  There is a lot of money to be made in copyrights and trademarks, and it helps having an agent who knows what he is doing in that area.  Anyway, enjoy the weekend.  See you back here on Monday!  Here are some stories I missed over the past week:</p>

<p>Before Bowl season, he was listed as the best Offensive Lineman going into the 2009 NFL Draft.  Then he was banned from playing in the Sugar Bowl for apparently having dealing with an agent (which is a big no-no when you are a collegiate athlete).  Even though Smith was suspended from what would probably have been the most important single game of his young career, no one thought that it would take any toll on his draft stock.</p>
<p>The winner of the Andre Smith sweepstakes was Alvin Keels and Global Management Group.  Many rumors had been circulating that Todd France and FAAM were the favorites, but Keels came out on top.  For the time being.  I doubt that Keels knew what he was getting into when the talented O-Lineman signed with his company.  Andre Smith ended up showing at the NFL Combine unfit to perform, refused to participate, and then fled the scene.  To make matters worse, the picture above came out and the press was eating it up.</p>
<p>Then Smith scored a 17 on his Wonderlic Test.  And then, with only days remaining before the NFL Draft, Smith dropped Keels in favor of Priority Sports.  Somehow, some way, Smith was a top 10 pick.  His thanks to Priority Sports was a big middle finger.  Yesterday, Jim Trotter of SI.com reported that Smith dropped Priority Sports and <a title="External Link" href="http://www.profootballtalk.com/2009/05/12/report-andre-smith-going-back-to-keels/" target="_blank">guess who Smith is apparently going to hire</a> to fill the void&#8230;Alvin Keels.</p>
<p>This is what Keels <a title="External Link" href="http://www.profootballtalk.com/2009/05/12/keels-responds-to-claims-of-fire-and-rehire-arrangement-with-andre-smith/" target="_blank">had to say in response:</a></p>
<p style="padding-left: 30px;">“I haven’t been rehired yet,” Keels told us via e-mail.  “Honestly, I might not get him back.  If I do get him back it definitely wasn’t planned that he fire then rehire me.”</p>
<p>But who fires an agent only to re-hire him later? Oh wait, apparently Jeremy Shockey is in the midst of doing the same thing with Rosenhaus Sports Representation as we speak.</p>
<p>Interestingly, Neil Stratton of InsideTheLeague.com reports that even before Smith first hired Keels, he was with DeBartolo Sports.  That means that once Smith officially signs with a new agent (or a new agent who also happens to be a former agent), it will be the fourth time he has signed on the dotted line.  Andre Smith has still not taken a snap in a professional game.</p>

			<content:encoded><![CDATA[<p><img class="alignright" style="border: 0pt none; float: right; margin-left: 10px; margin-right: 10px;" src="http://www.fansedge.com/Images/Product/31-61/31-61598-F.jpg" alt="Brian Westbrook" width="256" height="292" />Can&#8217;t wait to see what the <a title="External Link" href="http://www.nfl.com/news/story;jsessionid=63AFE2DF8E39D0EF473B90DC29F57B2B?id=09000d5d809da9e5&amp;template=with-video&amp;confirm=true" target="_blank">Brian Westbrook contract</a> looks like.  We are talking about a guy who is being talked about as being a potential number two overall pick in many fantasy football drafts this year.  <a title="Internal Link" href="http://www.sportsagentblog.com/?p=1569" target="_blank">He is already on his third agent</a> since joining the NFL and seems to like his new agent for what he has done thus far.  Todd France of FAAM (France AllPro Athlete Management) is hoping that for Westbrook, the third time is a charm.  France just finished negotiating a new 3-year, $21 million deal for his client.  <strong>The contract contains six pages with an additional fifty-two page addendum. </strong>I feel like a law school professor could teach a sports law class on that contract alone.</p>
<p>Here is a fabulous quote from France <a title="External Link" href="http://blogs.phillyburbs.com/blog.php/?p=33175&amp;cat=0" target="_blank">regarding the negotiations</a>:</p>
<blockquote><p>&#8220;We ran into so many obstacles,&#8221; France said. &#8220;The 12-month rule, the 30-percent rule, capped years, uncapped years, the Deion rule, and a 29-year-old running back who just fired his agent after nine months of negotiations. How are we going to fit together all these pieces of the puzzle? My first call to Joe [Banner, President of the Eagles], I said, ‘What am I getting into?&#8217;&#8221;</p>
<p>“<strong>Brian gave me three goals</strong> – the guaranteed money, the three years and a maximum number. The first thing he said to me tonight was, ‘You got me all three things. How can I be anything but happy?’</p></blockquote>
<p>$13 million is guaranteed over the next two years and Westbrook may receive a total of $21 million if an additional year is played with the Eagles.  With escalators being reached, that number could be bumped up to $24 million.  Early signs indicate that Westbrook will be happy in his third marriage to an agent and that Todd France just gave his client everything he asked for.</p>

			<content:encoded><![CDATA[<p><img class="alignright" style="border: 0pt none; float: right; margin-left: 10px; margin-right: 10px;" src="http://www.fansedge.com/Images/Product/31-61/31-61598-F.jpg" alt="Brian Westbrook" width="256" height="292" />As an agent in a professional sport, you must count your blessings every night and hope that your current clients do not ditch you for the hundreds of hungry agents working while you sleep.  There are more agents out there than potential clients (at least ones that will make you any money), and most players are wrapped up in the hands of the minority of very successful player representatives.  One agent that I am friendly with gave me some free advice and said, <em>If there is one thing you should do, it is take the names of your clients off of your web page.  You are asking for other agents to take that list and try to steal your clients away from you</em>.  I still debate following his word, but have kept the names of my clients public for the time being.</p>
<p>Whether other agents are approaching your clients or not, you can never be too sure that you have forged a strong relationship with those whom you represent; a relationship where they will smile at you one day and then drop you like a dime the next.  Just look at the Philadelphia Eagles as a case study.</p>
<p>Within a matter of days, Lito Sheppard and Brian Westbrook had dropped their agents and hired new ones.  Sheppard let go of All Pro Sports &amp; Entertainment Inc. in favor of Rosenhaus Sports Representation.  Westbrook said goodbye to Fletcher Smith, who had been basically working for free for the past nine months, and signed Todd France.  Even more proof that there is little loyalty is that Westbrook was managed by Eastern Athletic Services before firing them and hiring his now former agent, Fletcher Smith.</p>
<p>I am not saying that former player agents of Sheppard and Westbrook did not drop the ball.  I am merely noting how easy it is for a player to say goodbye to his agent and that there is little to no recourse.</p>

<p>Before the draft, <a title="External Link" href="http://www.forbes.com/business/2008/04/25/football-draft-caa-biz-sports-cx_tvr_0425draft.html" target="_blank">Forbes writer, Tom Van Riper</a>, dug up some interesting information from the NFLPA: <span id="lingo_span" class="lingo_region">23 separate agencies represented the first-round class in 2000. By 2007, that number was reduced by just one. This year, though, the number shrunk to just 18 agencies representing the 32 players projected to go in the first round by Scouts, Inc. CAA Football has five players, while Roanoke, Ind.-based Maximum Sports Management has four.</span></p>
<p>Scouts, Inc. was on the money.  Eighteen agencies are listed above.  CAA and Maximum Sports each got one more player selected than was hypothesized by the website.  Is it a bad thing that only only eighteen agencies are represented among the top 31 picks or that two agencies combined account for one-third of the players taken in the First Round?  It depends on who you ask.</p>
<p>CAA and Maximum Sports have been partying in their spare time (when they are not on the phone trying to hammer out fine details on each of their clients&#8217; contracts), but smaller agencies are wondering what they can do to break into this tough industry, and more precisely, the toughest sport in the profession.  Does it shock you that a large agency like Rosenhaus Sports Representation barely got a single player selected in the first round?  Miami did have a terrible year, so that may explain it.</p>
<p>Industry consolidation can be a beautiful thing if you are either the agency that is eating up the competition or an agency that is bought out by one of the behemoths.  If you are an agency stuck on the outside, do you start to become worried about your chances of breaking into the coveted First Round of the NFL Draft?</p>
